PIER 39 OFFICIAL RULES
NO PURCHASE NECESSARY TO ENTER OR WIN

Participation constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules. The Local Advantage The Ultimate Fleet Week Viewing Experience. Ticket Giveaway begins at 10:00 a.m. Pacific Standard Time (“PDT”) on Thursday, September 1, 2011 and shall end as of 10:00 a.m. on Wednesday, October 5, 2011 ("Contest Period").

Sweepstakes is sponsored by PIER 39 Ltd. Partnership, Beach Street & The Embarcadero, San Francisco, CA 94133 ("Sponsor"). Submissions received after Contest Period will not be eligible. All winners will be announced on or about Wednesday, October 5, 2011.

PIER 39 Official Contest Rules: All contest entries become property of PIER 39. Prizes are non-transferable or exchangeable and cannot be substituted. Prizes will be awarded as is, with no written or express warranty. Taxes, gratuities and all other incidentals or other expenses that may arise out of the winner’s receipt of the prize are the responsibility of the winner. All winners must be 21 years of age or older.
  • One entry per person, per day, per contest. • Employees of PIER 39 Limited Partnership, its licensees, PIER 39, PIER 39 Tenants, Blue & Gold Fleet, PIER Restaurants Inc., LLC, PIER 39 Marina, Moor + South, their subsidiaries, and the members of the immediate families are ineligible to participate or win. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household. • All prizes must be claimed within 24 hours of the date won or will be forfeited.
  • Winners will be asked to provide proof of age, identity and complete an affidavit of eligibility, liability and publicity release. • PIER 39 and promotional agencies assume no responsibility or liability for damages, losses or injuries resulting from, participating in, acceptance, or use of the prize.
  • By participating in the contest, the winner or winners (and their guest or traveling companion, if applicable) agree to have their name, voice or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation, and to sign a publicity release prior to acceptance of the prize.
  • By participating in any contest, entrants authorize PIER 39 to use their address, phone and email information for PIER 39 promotional use, with no further compensation.
  • If the prize is tickets to a performance, PIER 39 is not responsible for cancellations due to weather, promoter or performer.
  • Any violation of these rules will result in disqualification.
  • All decisions of PIER 39 are final.
  • PIER 39 reserves the right in its sole discretion to modify the contest rules and dates at any time for any reason. By participating in this contest, you agree to be bound by these contest rules, any modifications thereof, and by all other rules imposed by PIER 39 management. If due to circumstances beyond the control of PIER 39, any event associated with this contest or the prize is delayed, rescheduled, postponed or cancelled, PIER 39 reserves the right, but not the obligation, to cancel or modify the contest and shall not be required to award a substitute prize.
  • Contest void where prohibited. All federal, state and local laws and regulations apply.
  • No purchase is necessary. The contest is void where prohibited.
  • Failure to comply with the contest rules may result in a contestant’s disqualification, at the sole discretion of PIER 39.
  • PIER 39 is not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of the prize.
  • PIER 39 reserves the right to substitute a prize of greater or equal value at its sole discretion.
  • Profanity, abusive language, inappropriate dress or conduct deemed disorderly by PIER 39 management is grounds for removal from PIER 39 property
Conditions: Photo identification of the Grand Prize winner may also be required in order to collect the prize. Payment of all federal, state and local taxes are the sole responsibility of the winner. Winners will be required to sign an IRS Form W-9 or the equivalent. Winner will receive a 1099 for the value of the prize as stated in these contest rules. Winner is required to sign a release in order to receive their prizes. Failure or refusal to execute the release will result in winner forfeiting the prize. Pursuant to the liabilities release, the winners will agree to hold PIER 39, its licensees, PIER 39, PIER 39 Tenants, Blue & Gold Fleet, PIER Restaurants Inc., PIER 39 Marina, Moor + South, their subsidiaries, affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the sweepstakes.

For Internet sweepstakes: PIER 39, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of PIER 39 website or who is otherwise in violation of the rules. PIER 39 further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.

For Facebook sweepstakes: PIER 39, in its sole discretion, reserves the right to disqualify any person tampering with the entry process, the operation of PIER 39's Facebook page or who is otherwise in violation of the rules. PIER 39 further reserves the right to cancel, terminate or modify the contest if it is not capable of completion as planned, including infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort. This promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. Facebook is in no way responsible for the outcome of the sweepstakes. You understand that you are are providing your information to PIER 39 Ltd. Partnership and not to Facebook. You, the contestant, is providing PIER 39 Ltd. Partnership with your entry information and not Facebook.

One (1) grand prize winners will receive two (2) tickets valid for the Ultimate Fleet Week Viewing Experience on Saturday, October 8, 2011. The value of this package is $500.

Winners must be at least twenty-one (21) years of age to win and attend event. Tickets and gift certificate components may not be sold, redeemed for cash, traded, transferred, or rescheduled to dates other than as set forth above. Certain travel restrictions apply. PIER 39, its parent, subsidiaries, related and affiliated companies and their respective officers, directors employees and agents shall be released and discharged from any and all legal claims, losses, injuries, demands, damages, actions, and /or causes of actions which arise out of and/or in any way related to the prize, the receipt, use and/or enjoyment of the prize and/or the Promotion.
